The city of Terre Haute owns the cemetery. Often what is purchased are interment rights or memorial rights, and even in older cemeteries that were originally sold in terms of real estate (usually in square inches or feet), the law applies the modern understanding to rights. But these laws vary state to state. Indiana does seem to offer protection in terms of re-sell, which would seem to apply here, but it is problematic to prevent the lodge from removal. The cemetery trustees will hopefully be willing to take on this fight. Perhaps (and I sense this solution will rub some the wrong way) a fund should be raised not only to restore but to purchase the elk establishing clear ownership by the cemetery. In any case, the patina forms when the statue is not properly cared for. Some of these elks were originally painted and that paint not maintained. Others were given a patina coating which should have been cleaned and waxed each year. A bronze in good condition that has been well maintained should not look pitted or green. It should look either painted if that was the original finish or like a new bronze. I agree the patina on bronze is often attractive - but the other name for this heavy deterioration is "metal cancer". That blue/green patina is often so heavy because the statue was exposed for decades to acid rain and air pollution before we started cleaning up our act in that regard. Our cemetery lost its elk (which was pressed copper and therefore even more vulnerable to metal rot), and it has taken 20 years to fund a cast bronze replacement. We have spent about $60K over the last couple of years restoring 3 other significant bronzes. Bronze will last forever if it is kept waxed or coated. Otherwise it will deteriorate. A collector would never remove the patina from a collectible coin or rifle, but a statue in a cemetery is a different matter. You can restore it or you can watch it deteriorate until someday it is beyond restoration. It should not be removed from the cemetery. If it is cast bronze, I suspect restoration would cost about $30K. If it is pressed then probably double that. An American made to order replacement in standard thickness cast bronze starts at $90-150K.
